We reserve the right to accept or refuse any articles sent in for sale. Items with reserved prices will be charged 15% of the reserved price of each item offered and not sold. Reserves accepted only when authorized by the Auctioneer. Small items will be grouped in saleable lots at auctioneer’s discretion where possible All electrical appliances must be in good working order or repairs and handling charges will be billed to the account. Owners may not withdraw any property from sale after signing this agreement without a charge of 20% of the value of the goods. The highest bidder whose bid is accepted is the purchaser, but the Auctioneer may refuse any bid with or without cause and may withdraw any of the goods from sale before they have actually been knocked down to a bidder first anytime, with or without cause.
If any property remains unsold after the auctions or any sale does not complete for any reason, including non payment of the purchase price or a refund by us of the purchase price to the purchaser after return of the property AND IF such remaining property is not removed by you from the Auctioneer’s premises within 2 days after the date upon which the property was put up for auction. THEN at any time thereafter WITHOUT FURTHER NOTICE, we may sell and/or retain the property at our sole discretion and if we decide to sell the property the proceeds will be applied firstly in payment of all costs and expenses in relation to putting the property up for sale, secondly in payment of our commission, thirdly in payment of any handling and storage costs, and finally any excess will be be mailed to your last known address if we decide to retain the property then you MUST pay any and all advertising, moving, handling storage, or other costs and expenses incurred by us in relation to the said property AND (BY SIGNING THIS AGREEMENT YOU ACKNOWLEDGE THAT THE PROPERTY IS HELD AT YOUR RISK AND WE ARE NOT RESPONSIBLE FOR ANY DAMAGE, LOSS OR DESTRUCTION OF THE PROPERTY)
You, the owner hereby promise to indemnify and save harmless us from any and all costs, claims expenses or liabilities which we may incur or be put to (including legal fees on a solicitor and client basis) as a result of any claim made by, for or through the Purchaser of third party arising from the sale of your property.
Settlement of this account cannot be made until 10 days after conclusion of sale, Cheques made on completion of this account to your last known address and IF YOU HAVE MOVED we have no further responsibility in attempt to locate you because IT IS YOUR RESPONSIBILITY to contact us and arrange to pick up your cheque. We are under no obligation to enforce payment by any purchaser. IF a purchaser does not pay you whatsoever we will mail a notice of this event in your last address, and, while we reserved the right to cancel the sale and return the property, we may, at our sole discretion, put the property up at a later auction PROVIDED THAT IF AS A RESULT OF A SALE NOT HAVING COMPLETE ANY PROPERTY IS AUCTIONED MORE THAN ONCE WE NEED NOT OBTAIN A PRICE EQUIVALENT TO THE FORMER HIGHEST BIG PRICE and are not liable in any way for accepting any lesser price. Should we cancel the sale and return your property then ANY FURTHER DEALING OR ACTIONS FOR SPECIFIC PERFORMANCE AGAINST THE PURCHASER SHALL BE YOUR RESPONSIBILITY
Riverside Auctions is responsible for all monies collected.
WHEREAS the Owner desires to sell by public auction the items listed.
AND WHEREAS the Owner desires to employ the Auctioneer herein to conduct the sale of the items listed before or after auction.
Taxes will be charged in accordance with Government Regulations
All payments include applicable taxes.
GOODS LEFT AT OWNER’S RISK
In lieu of our providing coverage YOU HAVE ELECTED TO INSURE YOUR PROPERTY YOURSELF by signing this agreement you release us from any liability for loss of damage to your property, you and/or your Insurer [If any) whether such loss of damage is caused by our negligence or otherwise waive any right of subrogation against us, our agents, employees and contractors)
